Basildon Council’s planning permission double standards exposed
As Basildon Council considers planning permission for housing developers on agricultural land, residents claim “it’s one rule for us, and another rule for everyone else”.
Just hours after leaving a High Court hearing on a judicial review application against the eviction of Dale Farm, Basildon Council is heading to a meeting on housing development looking to approve housing on land currently being used for agricultural purposes.
Basildon’s planning committee recommends development on the land, despite objections from Runwell Parish Council that it’s “Inappropriate development of a Green Belt/green field site – there is currently no LDF and the Local Plan policies are out of date – there are an adequate number of alternative sites in Wickford and Runwell for development – the site
is important for wildlife” [1]Despite arguing in court that the widely criticised eviction of a former scrapyard was necessary because of breach of greenbelt planning regulations, the Basildon Council Development Control and Traffic Management Committee are considering a 68 dwelling planning application at land south of Downham Road, Wickford. Basildon Council has submitted a recommendation that the application be granted planning permission.
The meeting is taking place at 7pm at Mirren Studio, Towngate , Theatre, St. Martin’s Square, Basildon SS14 1DL .
Kathleen McCarthy, a resident of Dale Farm, said
“I don’t begrudge anyone a home who needs it, but why is Basildon Council willing to give planning permission to developers on agricultural land while at the same time forcing us from our homes. Dale Farm was a scrapyard when we bought it over ten years ago, but now it’s a community that just wants to live in peace. It seems like it’s one rule for Travellers, and another rule for everyone else.”
It was heard in court today that Basildon Council knew that there was a need for 62 new pitches but they only provided two. It was also heard that Basildon Council failed to discuss site provision at a Council meeting in August. 90% of planning applications made by Travellers are rejected compared to 20% for the whole of the UK [2]

Dale Farm Solidarity Photo Campaign: Time to get involved!
Today marked the launch of the Dale Farm Solidarity Photo Campaign.
In an attempt to dispel the myth that ‘no-one cares’ about the people of Dale Farm, we’ve launched a simple campaign to do the talking. All you need to do is write the words ‘I Support the Families of Dale Farm’ on a piece of paper and photograph yourself with it. Points will be awarded for the creativity of the place the photograph is taken (outside the Department for Communities and Local Government, for example).
Rhys Williams, a charity worker from South London, shows how easy it is.
However the most important thing is that we get your picture. Either email it to savedalefarm@gmail.com or post it on our Facebook group.
It is vital that the families of Dale Farm are able to see the amount of support that exists . If you want your details posted with it, then send that too.
So come on friends, get photographing! And remember, sometimes a picture is worth a thousand words.

Basildon Council launches internal investigation into botched Dale Farm eviction
At the direction of Tony Ball, leader of Basildon Council, an internal investigation has been launched into allegations of mismanagement, fraud and corruption dating back 30 years in relation to the Council’s handling of the botched Dale Farm eviction. Bala Mahendran, Chief executive of Basildon Council wrote: “I have taken the opportunity to discuss these matters with the Chief Superintendent of Essex Police, Divisional Commander for the Basildon Borough, who has agreed that should the Council’s investigations and any related evidence identify potential criminal actions or activity that Essex Police will take over the investigation.” [1]
In an email to Stuart Hardwicke Carruthers, who discovered flaws with the eviction notices served by the Council, Tony Ball wrote,”Given the serious nature of the issues that you have raised and concerns raised under the Council’s Whistle Blowing Policy, the Council will respond as soon as possible to these issues.”
Mr. Hardwicke Carruthers alleges that senior officials misled the Council as to the legality of a full clearance of Dale Farm. On Monday this week, Mr Justice Edwards Stuart ruled that the full clearance of Dale Farm was illegal. He criticised Basildon Council for failing to fully inform the travellers of the precise means by which it would enforce the eviction and stated that “there was a realistic apprehension that the measures to be taken – while genuinely believed in by the Council – may go further than the terms of the enforcement notices.”[2] The attempt to over-enforce the eviction notices has led to millions of pounds being wasted by Basildon Council.
Further allegations of fraud and corruption relate to the dumping of hardcore and clay onto Dale Farm by the Council before it was bought by the Dale Farm residents, and accusations that money which was paid to store cars on the Dale Farm scrapyard was never properly accounted for [1,3].
The eviction is currently on hold until at least Wednesday, when the High Court is expected to rule on three Judicial Reviews. Kathleen McCarthy, a resident of Dale Farm, and lead member of the Dale Farm negotiation team called again on Basildon Council to return to the table. She stated, “There is still time to talk and find a common sense solution. Basildon Council has been offered free land and resources to resettle us and we hope they will accept this offer.”[4]
