1. I refer to Mr Green’s memorandum dated 30 October, seeking leave to apply for home detention in lieu of part of the sentence of 23 months imprisonment by this Court on 30 September when granted an appeal by the Solicitor-General.
2. Judge Gittos imposed a sentence of eight months imprisonment in the District Court at Auckland.
Mr Green did not appeal against the Judge’s failure to impose a sentence of home detention nor did Mr Green submit that a sentence of home detention should be imposed when Court heard the Solicitor-General’s appeal on 26 September.
3. This Court has no jurisdiction to determine Mr Green’s complication, which is declined.
