ok, since this has become a very popular topic, we'd like to consolidate all discussion in a single place. so here it isthere are several other threads about this situation here. the two most active ones have been locked and pointed here to avoid confusion. they are still available for reading, and i made them both stickies to move them to the top of the general file sharing discussion index. [edit - new forum created] here are the links:
Dream Pinball 3D thread
Colin Mcrae Dirt threadif you are involved in this, and have not yet done so, i strongly suggest you read both of these threads. yes, they are both quite long, but if this legal situation affects you, i think you will find them an invaluable resource.
in the meantime, please continue the discussion here

Switched. I'm a bit concerned about the final line on the latest "we recommend you seek the advice of an professional IT consultant as soon as possible" letter which reads".....We await your response, in the meantime, we expressly reserve our clients rights"
What am I meant to be responding to? The letter states that
"...we are considering with our client whether to take proceedings against you in any event"....etc
Does that mean that they are now considering NOT taking action? None of their correspondence ties up

i am not sure what exactly they expect your reply to discuss. in answer to your second question, i'd say yes, it sure looks that way, especially in light of the comments allegedly made to the TV reporter.Posts: 11376 Joined: Wed Aug 17, 2005 4:48 pm Re: The new official Davenport-Lyons lawsuit thread

The only concern i would have about slyck being the main source of info re davenport lyons intimidation of innocent people is that slyck is a source of info to do with file sharing. However, thus far, they have been the only forum in support of those unfairly accused and an invaluable asset to the many innocent people being accused of something they haven't done.
Enigmax and torrentfreak have also been brilliant, at least the current media interest that DL has instigated is being looked at and not particularly in DL's favour.

I relish the thought that their latest PR stunt to try and intimidate more people into paying up could lead to their downfall. He who lives by the sword, dies by the sword.....hopefully

viewtopic.php?p=483210#p483210the comment about not going after people who put up a defense was posted by a reader of the register's article. this point seems to be disputed (like everything else about this whole thing )

Yes, good idea to point them all to one thread, as this matter needs to avoid confusion. The information put out by the media has been less than reliable and should be taken with a grain of salt. Only trust official and truthful sources.
Anybody have a better source to read our stuff on? BBC is just misreporting, and as nice as it is to read torrenfreak and whatnot, is their information just as biased, but the other way?

I think Torrentfreak has an obvious slant, but I believe they are factually more accurate than the vast majority of sites who seem to just publish DL's press releases (including, rather depressingly, the BBC who have gone way down in my opinion recently). The fact that Enigmax waited until things had become a little clearer before running his latest article says a lot for his journalistic integrity.I tend to agree that having a file sharing site as the main location for anti-DL info is not doing any of the accused any favours. Much better to set up a seperate, independent site specifically for this (not tricky or expensive really) and then link to it from here. Surely someone here with a vested interest has the time and know-how?

Moving on without becoming the topic of discussion myself , I can now confirm the good news. I have a proper IP lawyer lined up to speak to everyone who has a case, for free. As soon as I have more details i'll be sure to let you know. It might be a good idea at this point for everyone to collate all of their paperwork and correspondence so far with Davenport so that this guy and his team can assess your case efficiently, since they're likely to be flooded with work.Posts: 797 Joined: Mon Jan 22, 2007 6:58 am Location: torrentfreak Re: The new official Davenport-Lyons lawsuit thread

Great news Enigmax, when you say 'free' do you mean so far as an initial consultation or further than that? Paying for aid isn't a problem though.Posts: 62 Joined: Sat Aug 02, 2008 3:45 am Re: The new official Davenport-Lyons lawsuit thread

Probably more than that Duracell...Ok, since this guy has limited resources and I would prefer that the long-suffering ppl in this thread get first chance at support, please email me on enigmax[at]torrentfreak.com asap including your Slyck username and a link to your profile here. I think its fairer to let the people who have participated the most here get the first chance, so please - email me quickly! I'll be writing an article about this today so after that goes out, you could find yourself substantially down the queue for support.
update: i'm already overloaded with people so I don't think there its even possible to be 'fair' in this respect. apologies

To be honest even if all our cases don't get heard by this person it wouldn't matter as much, because it really takes on case to set a precedent. I'd also imagine that any advice that comes out will be passed around as well given that we are all pretty much in the same boat as far as circumstances go.

I would just like to say a big thanks to Enigmax, She put me in touch with her IP solicitor and ive already had a reply from said lawyer and things are moving positively already. So as to make as little work for the lawyer as possible, i suggest people wishing to enroll his /her help, make electronic copies of letters etc, and get everything lined up and dotted as they can.

As Ive mentioned, Im not even close to affected by the current DL letters, but this is a HUGE warm glow in my heart. All the way down to the sub-cocklesenig, and the poor, poor soul who is offering his/her services

Ditto what everyone else has said - many thanks for sorting this out. A very positive step.I am fairly confident of my own dealings with DL so far and hoping I've put them straight myself - still waiting to hear for definite. I will therefore step aside for now and let more needy people take the first advice. However, if it is a case of getting as many numbers on board then let me know (via PM) and I'm happy to join in. I already have all correspondence scanned.
